Federal Court Orders Release of Kilmar Abrego Garcia from ICE Detention

A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement is without lawful basis.

"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis stated in her ruling.

The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later acknowledged was an mistake. Following his return to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the judge pointed out that the authorities does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "for now."

Background of the Legal Challenge

The legal proceedings involve disputed claims. Whereas the Trump administration contends that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling charges, which are part of a separate criminal case in the state of Tennessee.

The court, who was hearing his petition to deportation in a federal court, determined that he must now adhere to the terms of his release from jail in Tennessee. This order shifts his supervision to the jurisdiction handling his criminal case.
